What to Know About Requesting Public Information

In short, the Public Information Act (PDF) does not require a governmental body to create new information, do legal research, or answer questions, and the request must be for records already in existence. The governmental body has 10 business days to respond to the request. Day One is the first business day after receipt of the request. If the request is submitted after business hours, 8am to 5pm, the request is considered received the next business day. If submitted over the weekend, the request is considered received on Monday, and Tuesday is Day One for calculating the 10 business days.
Please Note: State law allows governmental bodies to recover costs associated with open records requests. These rates are set pursuant to the Texas Administrative Code.
NTMWD will assess a charge for open records requests that total or exceed $40 to process. A cost estimate will be provided for requests that total or exceed $40.

NTMWD reserves the right to withhold requested information that is exempt from public disclosure under the Public Information Act or any other applicable law. If NTMWD seeks a disclosure exception from the Texas Attorney General, you will be notified.
When requesting open records/public information, members of the public are strongly encouraged to submit written requests electronically through our Records Request Portal, rather than sending an email.

In accordance with Section 552.234 of the Texas Government Code, requests will not be processed if submitted to any other email address. - Written requests may be dropped off at 501 E.
